Remembering the Disappeared, Fighting Forgetfulness

The International Day of the Disappeared on August 30 is an annual commemoration day created to draw attention to the fate of individuals who have disappeared, imprisoned at places and under conditions unknown to their relatives or legal representatives. In Indonesia, the commemoration has been started with various activities, under the theme of “Remembering the Disappeared, Fighting against Forgetfulness”. The commemoration this year is aimed remembering all those made disappeared because of government repressive policy in the past. By remembering them and their circumstances, we expect that such tragedy will never happen again in the future.

Nature of disappearances
By nature, enforced disappearance is considered as "the perfect crime" since both the victim and the perpetrators "give no evidence and provide no identification". The disappearance of physical and tangible evidences of crime allows this "crime against humanity" to freely inflict terror like ghosts, as it escapes the borders of reason.

As this crime thrives in a culture of impunity, victims of disappearances are left in a limbo of existence and non-existence; of remembrance and oblivion; of life and death. The bereaved families, on the other hand, are torn between hope and despair; of remembering and forgetting; of living and dying.

Quite significantly, however, families have shown great resilience from succumbing to depression, forgetting and hopelessness. They constantly found ways to carry on with their lives, finding hope and courage to fight for Truth and Justice in memory of their vanished husbands, brothers, sons, wives, sisters, and daughters.

Convention Against Disappearances
The International Day of the Disappeared is also marked with the successful adoption by the UN General Assembly in December last year of the UN International Convention for the Protection of All Persons from Enforced Disappearance (Convention Against Disappearances). The Convention that has legal binding to the State Party will be a significant legal international human rights instrument to fill the absence of such instrument in national and international level. As of now, Indonesia and most countries have no national mechanism criminalizing disappearances nor Asian regional mechanism on disappearances like that in Latin America.

In the commemoration of the International Day of the Disappeared, the relatives of victims are expecting that the government sign the Convention Against Disappearances as promised by Human Rights Minister Hamid Awaluddin in the High Level Segment speech of the UN Human Rights Council meeting in Geneva, Swiss last March 2007. Signing the Convention Against Disappearances as an initial step towards ratification will prove that the government’s commitment is not only on paper. It will also strengthen Indonesian strategic position in the United Nations, especially in the UN Human Rights Council and UN Security Council.

When ratified, Indonesia will have to comply with the Convention, and along with the world will help stop, prevent, prosecute the perpetrators of disappearances, fulfill the rights of the victims and their relatives and make disappearances history of the past.

The outstanding cases
In October 2006, national Commission on Human Rights (KOMNAS HAM) finished the reports on the inquiry of the cases of disappearances happened in 1997 – 1998. In the reports, KOMNAS HAM found that there are 23 persons reported disappeared. Of the 23 cases, one found dead, nine resurfaced or released in 1998 and the remaining 13 are still disappearing up until today.

In the recommendation, KOMNAS HAM asks the Attorney General to investigate the case based on the Law No 26/2000 on Human Rights Court. The President and the Parliament are also recommended to expedite the process the establishment of Human Rights Court and to deliver the rights of the victims to reparations which include compensation, restitution and rehabilitation.

Of the whole recommendations by Komnas HAM, no satisfactory progress has been made, but the Attorney General awaiting the parliament for political decision on whether the cases being investigated are gross violations of human rights or not. This the most worrying process experiences by the victims and their relatives.

It is in the occasion of the International Day of the Disappeared that the government is expected to make a breakthrough by having the Attorney General investigate the cases, without waiting for the Parliament for political decision. Political decision by parliament is needed only for the cases of the past that happened before the enactment of the Law on Human Rights Court in 2000. Considering the fact that disappearances are continuing crimes by nature, as long as the fate and whereabouts of the victims are not yet clarified make the cases under the jurisdiction of the normal Human Rights Court, like those of the case of Abepura tackled by the Human Rights Court in Makasar in 2005.

Dalam sepekan terakhir, perhatian kita banyak tertuju pada perkembangan politik di Argentina, terutama karena adanya pemilu yang akhirnya dimenangi Cristina Hernandez Kirchner, yang kebetulan adalah istri Presiden Argentina saat ini, Nestor Kirchner.

Cristina memenangi pemilu bukan hanya karena ia seorang negarawan nan rupawan dan cerdas, tapi karena ia menjanjikan kebijakan yang berpihak pada kaum papa Argentina, sebagaimana selama ini telah dibuktikan oleh sang suami Presiden Kirchner. Salah satu langkah radikal yang telah diambil oleh Presiden Kichner adalah untuk melepaskan ketergantungan Negara pada lembaga keuangan internasional, IMF.

Tulisan ini tidak dimaksudkan untuk mengupas presiden terpilih Cristina Kircher, ataupun keberhasilan Argentina membangun kebangkitan ekonomi paska krisis 2001 dengan cara melepaskan ketergantungan pada IMF. Tulisan ini dimaksudkan untuk melihat aspek lain “keberhasilan” Argentina, yaitu dalam mengelola masa lalu yang hitam yang terjadi pada masa kediktatoran Junta Militer 1976 – 1983.

Pada periode tersebut pelanggaran HAM terjadi sangat masif. Laporan Komisi Penyelidik Nasional untuk Penghilangan Paksa (CONADEP) tahun 1984 mencatat adanya 8.960 korban penghilangan orang secara paksa (orang hilang) dan 340 tempat penahanan dan penyiksaan rahasia. Bahkan organisasi-organisasi HAM di sana mencatat korban orang hilang mencapai 30.000 orang.

Sebelum dihilangkan, para korban terlebih dulu diculik, ditahan, disiksa lalu dihilangkan oleh alat-alat represi Junta Militer yang disebut “death squads” atas nama doktrin keamanan nasional. Sebagian diantaranya dibuang hidup-hidup di Samudera Atlantik dengan pesawat (death flights). Pimpinan Junta, Jenderal Videla mengatakan pada waktu itu, “Berapapun banyaknya orang harus mati, demi keamanan negeri ini”.

Menghapuskan Impunitas
Presiden sipil baru paska Junta Militer, Raul Alfonsin pada tahun 1983 membentuk sebuah komisi nasional untuk menyelidiki kasus penghilangan paksa yang terjadi pada masa periode kediktatoran Junta Militer 1976 – 1983. Pada November 1984, komisi penyelidik ini mempublikasikan hasilnya yang diberi judul Nunca Mas, yang berarti Jangan Terjadi Lagi. Laporan yang dalam pengantar salah satu edisinya disebut sebagai ‘laporan dari neraka’ ini membuat panik para pimpinan Junta dan para militer pendukungnya. Mereka semua membantah dan menolak untuk dimintai pertanggungjawaban.

Bukan hanya itu, merekapun mengancam untuk melakukan pemberontakan bila mereka dibawa ke pengadilan. Akhirnya pada tahun 1986 dan 1987 Presiden Raul Alfonsin mengeluarkan 2 undang-undang amnesti yang disebut La Ley de Punto Final (The Full Stop Law) dan La Ley de Obediencia Debida (The Law of Due Obedience). Dua undang-undang ini menjadi antiklimaks atas proses pertanggungjawaban pelaku pelanggaran HAM yang sebenarnya sudah dimulai dengan penyelidikan oleh CONADEP. Yang lebih buruk lagi, presiden baru Carlos Menem memberikan amnesti kepada pejabat militer yang terlibat dalam pelanggaran HAM masa kediktatoran.

Sebagaimana alur sejarah, politik Argentina juga bergerak maju. Hampir 20 tahun kemudian, pemimpin-pemimpin konservatif yang abai dan ingkar demokrasi dan HAM tidak banyak mendapat tempat. Pemerintahan Kirchner melakukan gebrakan radikal dalam bidang HAM ketika pada bulan Juni 2005 Mahkamah Agung Argentina menganulir dua undang-undang amnesti 1986 dan 1987 itu karena dianggap inkonstitusional. Selanjutnya proses pengadilan terhadap mereka yang bertanggung jawab atas pelanggaran HAM pada masa 7 tahun kediktatoran bisa dimulai lagi.

Hingga saat ini, FEDEFAM, Federasi Organisasi Keluarga Korban Penghilangan Paksa di Amerika Latin mencatat sekitar 160 anggota militer sudah diadili, 4 diantaranya berpangkat Jenderal. Selanjutnya sekitar 250 anggota militer yang lain masih menunggu pengadilan.

Perhatian pada korban
Usaha penanganan berbagai kasus pelanggaran HAM masa lalu seringkali mengabaikan kepentingan korban dan keluarganya. Penanganan kasus pelanggaran HAM biasanya dianggap usai ketika pengadilan telah digelar atau sedikit kebenaran telah terungkap, walaupun hanya di tataran formal. “Keadilan formal” seperti ini sering berakhir pada penelantaran korban dan keluarganya.

Tidak perlu jauh-jauh, kita bisa melihat fenomena ini pada proses penanganan kasus pelanggaran HAM yang terjadi Timor Leste dan Tanjung Priok 1984. Walaupun pengadilan HAM ad hoc telah digelar di Jakarta dan Komisi Kebenaran dan Penerimaan (CAVR) juga telah diselesaikan di Timor Leste, korban masih belum mendapatkan hak-hak pemulihan (rights to reparations) yang layak.

Hal yang sama terjadi pada korban dan keluarga korban Tanjung Priok 1984 yang sudah diselesaikan di pengadilan HAM ad hoc. Perjuangan korban untuk mendapatkan kompensasi, restitusi dan rehabilitasi (hak-hak pemulihan) kandas, begitu Mahkamah Agung memutus bebas semua terdakwa. Pelanggaran HAM dianggap tidak ada, dan karenanya keberadaan korban tidak diakui.

Argentina memilih jalan berbeda dalam mengelola sejarah hitam masa lalu. Selain dengan mengungkap kebenaran melalui CONADEP, pemerintah Argentina saat ini juga mengambil jalan pengadilan bagi mereka yang terlibat dan bertanggung jawab dalam serangkaian tindakan penculikan, penyiksaan dan penghilangan orang pada masa kediktatoran.

Tidak hanya itu, Argentina juga mengeluarkan sejumlah kebijakan dalam bentuk undang-undang untuk merestorasi korban dan keluarga yang ditinggalkannya. Undang-undang yang telah dikeluarkan sekitar 12 tahun yang lalu ini mengatur status sipil korban penghilangan paksa (Civil Status Law) dan kompensasi (Special Benefit Law). Melalui dua undang-undang ini, keluarga korban bisa mendapatkan hak-hak kompensasi dari Negara sebesar kira-kita 100 dollar Amerika perbulan selama 20 tahun yang diambil dari kas Negara (state bond).

Untuk hal-hal yang berhubungan dengan administrasi kewarganegaraan sehari-hari, mereka yang hilang bisa mendapatkan status absence due to enforced disappearances atau absence on presumption of death setelah dilakukan verifikasi oleh lembaga resmi Negara. Status demikian memudahkan anggota keluarga bisa melakukan kepengurusan warisan, transaksi bisnis, hak pensiun, hak milik dan sebagainya. Status absence due to enforced disappearances mensyaratkan Negara untuk terus berusaha melakukan penyelidikan (criminal investigation) bagi yang bersangkutan.

Argentina bukan Negara maju dengan catatan HAM yang sangat mengagumkan. Tetapi Argentina telah menunjukkan kemampuannya untuk bangkit dari kebangkrutan ekonomi yang sempat memporakporandakan segala sendi kehidupan rakyatnya pada tahun 2001 dengan mengatakan ‘tidak’ pada resep IMF. Argentina juga telah menunjukkan keberanian, kebijaksanaan dan kedewasaannya dalam mengelola sejarah hitam masa lalunya dengan baik, dengan membentuk komisi kebenaran, pengadilan dan pemenuhan hak-hak korban. Argentina telah berusaha untuk benar-benar mengatakan tidak pada kesalahan dan sejarah hitam masa lalu dengan satu semboyan; Nunca Mas!, Jangan terulang lagi!

IKOHI was set up on September 17, 1998 by the parents and surfaced victims of disappearances. Since then, IKOHI was assisted by KONTRAS, until October 2002 when finally IKOHI carried out it first congress to complete its organizational structure. In the Congress, IKOHI decided its two priority of programs. They are (1) the empowerment of the social, economic, social and cultural potential of the members as well as mental and physical, and (2) the campaign for solving of the cases and preventing the cases from happening again. The solving of the cases means the reveal of the truth, the justice for the perpetrators, the reparation and rehabilitation of the victims and the guarantee that such gross violation of human right will never be repeated again in the future.
